1. Introduction

These Terms and Conditions (“Terms”) govern the use of the website www.swissexperiences.com (the “Website”) and the services provided by Swiss Experiences, a platform owned and operated by St-Arnaud Productions (“we”, “us”, or “our”).

By accessing the Website, making an inquiry, booking a service, or purchasing a voucher, you agree to be bound by these Terms.

The website www.swissexperiences.com (the “Website”) is owned and operated by St-Arnaud Productions (“St-Arnaud Productions”, “we”, “us”, or “our”). Swiss Experiences is a proprietary platform and brand operated by St-Arnaud Productions.

St-Arnaud Productions is a Switzerland-based company specializing in the design, production, and curation of luxury travel experiences and bespoke journeys in Switzerland.

3. Scope of Services

Swiss Experiences offers the following three (3) core services:

2.1 Signature Experiences

Curated luxury experiences in Switzerland lasting from half a day up to a maximum of one (1) full day (“Signature Experiences”). These experiences may be booked directly for a specific date or purchased as gift vouchers, subject to availability and specific conditions outlined in Section 5.

2.2 Curated Journeys

Pre-defined short luxury travel packages lasting two (2) to three (3) days (“Curated Journeys”). These journeys are carefully designed by Swiss Experiences and include a fixed itinerary with selected accommodations, experiences, and services. Limited customization may be possible upon request and may incur additional costs.

2.3 Custom-Made Travel Design

Fully bespoke luxury travel design services for journeys of five (5) days or longer (“Custom-Made Travel Design”). This service includes personalized itinerary planning, experience curation, accommodation selection, logistics coordination, and optional on-ground concierge support.

4. Contract Formation

A binding contract is formed when:

  • Swiss Experiences confirms a booking or service in writing (email or digital confirmation), and

  • The required deposit or full payment has been received.

Any proposals, itineraries, or quotations provided prior to confirmation are non-binding and subject to availability and change.

5. Pricing & Payments

5.1 Pricing

All prices are quoted in Swiss Francs (CHF) unless otherwise stated. Prices may include third-party services such as hotels, guides, transportation, or experiences and are subject to availability at the time of booking.

5.2 Payments

Payment terms will be communicated in writing and may include:

  • A non-refundable planning or design fee

  • A deposit (typically 30–50%) upon confirmation

  • Final balance due prior to travel or experience date

St-Arnaud Productions reserves the right to withhold services if payments are not received by the agreed deadlines.

5.3 Third-Party Costs

Certain third-party providers may impose additional terms, cancellation fees, or payment conditions, which will apply in addition to these Terms.

6. Signature Experience Vouchers

5.1 Voucher Use

Signature Experience vouchers (“Vouchers”) may be purchased directly via the Website or upon request. Vouchers are redeemable exclusively for the experience specified or for the stated monetary value, subject to availability.

5.2 Validity

Unless otherwise stated, vouchers are valid for twelve (12) months from the date of issue. Expired vouchers cannot be redeemed or refunded.

5.3 Redemption

Voucher redemption requires advance booking and is subject to availability, seasonal restrictions, and provider confirmation. Blackout dates may apply.

5.4 Non-Refundable & Non-Exchangeable

Vouchers are non-refundable and cannot be exchanged for cash. Name changes may be permitted at Swiss Experiences’ discretion.

5.5 Partial Use

If the value of a voucher exceeds the value of the redeemed experience, no cash balance will be issued unless explicitly stated.

7. Changes, Cancellations & Refunds

Swiss Experiences, operated by St-Arnaud Productions, designs and delivers high-end, time-sensitive services. The following conditions are structured by service type to ensure clarity, fairness, and compliance with applicable Swiss and EU consumer protection laws.

6.1 General Principles (Applicable to All Services)

  • All changes and cancellations must be submitted in writing.

  • Any modification requested after confirmation is subject to availability and may result in additional costs.

  • Third-party supplier terms (including hotels, guides, transport providers, venues, and experience hosts) apply in addition to these Terms and may be more restrictive.

  • No refunds are granted for no-shows, late arrivals, early departures, or unused services.

  • Where services are provided for a specific date or period, statutory withdrawal rights may not apply once confirmation has been issued, in accordance with applicable Swiss and EU law.

6.2 Signature Experiences

(Half-Day to One-Day Experiences, including Vouchers)

Signature Experiences are leisure services provided for a specific date and are therefore subject to strict cancellation conditions.

  • Once a Signature Experience is confirmed for a specific date, it is non-refundable.

  • Date change requests may be submitted up to 72 hours prior to the scheduled experience and are subject to availability. Additional costs may apply.

  • Cancellations or change requests received less than 72 hours before the experience, as well as failure to attend, will result in 100% forfeiture of the booking value.

  • Experiences affected by severe weather or force majeure events may, at Swiss Experiences’ discretion, be rescheduled. Refunds are excluded unless mandatory law provides otherwise.

Vouchers (Signature Experiences)

  • The purchase of a Signature Experience voucher constitutes the purchase of a prepaid leisure service, not the booking of a specific date.

  • Vouchers are non-refundable from the moment of purchase, except where mandatory consumer law applies.

  • Voucher validity periods apply strictly. Expired vouchers cannot be redeemed and are not refundable.

  • Once a voucher is redeemed and an experience date is confirmed, the booking is treated as a date-specific leisure service and is subject to the same cancellation, change, and no-show conditions as direct bookings.

  • Cancellation or non-attendance by the voucher beneficiary does not entitle the purchaser to a refund.

  • Rebooking requests after voucher redemption are subject to availability and may incur additional costs.

6.3 Curated Journeys

(Pre-Defined 2–3 Day Packages)

Curated Journeys involve multiple coordinated services and limited availability.

  • Cancellations received 14 days or more prior to departure may be eligible for a partial refund, excluding any non-refundable third-party costs.

  • Cancellations received 13 days or less prior to departure may result in partial or full forfeiture of amounts paid, depending on supplier cancellation policies.

  • Once a Curated Journey has commenced, no refunds will be issued for unused services.

  • Changes requested after confirmation may require itinerary adjustments and may incur additional fees.

In accordance with EU consumer law, Curated Journeys constitute leisure services provided for specific dates and are therefore exempt from statutory withdrawal rights once confirmed.

6.4 Custom-Made Travel Design

(Journeys of 5 Days or More)

Custom-Made Travel Design services are bespoke, resource-intensive, and tailored to individual client requirements.

  • Planning and design fees are non-refundable under all circumstances, including cancellation of the journey.

  • Cancellations received more than 30 days prior to departure may be eligible for a partial refund of amounts paid, minus design fees and any non-refundable third-party costs.

  • Cancellations received 30 days or less prior to departure may result in partial or full forfeiture of amounts paid, depending on supplier cancellation terms.

  • Any changes requested after confirmation may require re-design and may be subject to additional planning fees.

  • No refunds are granted once travel has commenced.

6.5 Force Majeure

Neither Swiss Experiences nor St-Arnaud Productions shall be liable for failure to perform or delay in performance resulting from events beyond reasonable control, including but not limited to natural disasters, extreme weather, strikes, political events, pandemics, or supplier insolvency.

In such cases, reasonable efforts will be made to offer alternative arrangements or rescheduling, without guaranteeing refunds unless required by applicable law.

8. Client Responsibilities

Clients are responsible for:

  • Providing accurate personal and travel information

  • Ensuring valid passports, visas, and travel documents

  • Complying with local laws, regulations, and customs

  • Obtaining appropriate travel insurance

Swiss Experiences is not responsible for issues arising from incomplete or incorrect information provided by the client.

9. Travel Insurance

Comprehensive travel insurance is strongly recommended and should include coverage for trip cancellation, medical expenses, personal liability, and activities included in the itinerary.

10. Liability & Disclaimer

10.1 Limitation of Liability

Swiss Experiences acts as a coordinator and intermediary between clients and third-party suppliers. We are not liable for the acts, omissions, negligence, or defaults of such suppliers.

To the maximum extent permitted by Swiss law, Swiss Experiences’ liability is limited to the total amount paid by the client for the relevant service.

10.2 Assumption of Risk (Signature Experiences & Curated Journeys)

Certain Signature Experiences and Curated Journeys may involve inherent risks, including but not limited to outdoor activities, alpine environments, weather conditions, physical exertion, or food-related sensitivities.

By booking or participating, clients confirm that:

  • They are physically and medically fit to participate

  • They will follow instructions provided by guides, hosts, or suppliers

  • They voluntarily assume all risks associated with participation

Swiss Experiences accepts no responsibility for injury, illness, loss, or damage resulting from participation, except where caused by gross negligence or willful misconduct under applicable law.

10.3 Food, Allergies & Special Requirements

Clients are responsible for informing Swiss Experiences in writing of any dietary restrictions, allergies, or medical conditions prior to confirmation. While reasonable efforts will be made to communicate such requirements to suppliers, Swiss Experiences cannot guarantee an allergen-free environment.

11. Design Fees, Concept Ownership & Intellectual Property (Custom-Made Travel Design)

10.1 Planning & Design Fees

For Custom-Made Travel Design services, Swiss Experiences may charge a non-refundable planning and/or design fee. This fee compensates for professional expertise, research, concept creation, itinerary structuring, and supplier sourcing, regardless of whether the client proceeds with full booking.

10.2 Ownership of Concepts & Itineraries

All travel concepts, itineraries, schedules, route designs, experience combinations, and proposals created by Swiss Experiences remain the intellectual property of Swiss Experiences until full payment of the agreed services has been received.

Clients are expressly prohibited from:

  • Reproducing, copying, or sharing itineraries or concepts with third parties

  • Using proposals to book independently or through other agencies

  • Distributing or reselling any part of the designed journey

10.3 Permitted Use

Upon full payment, clients are granted a limited, non-transferable right to use the itinerary exclusively for their personal travel purposes.

10.4 Breach

Unauthorized use of Swiss Experiences’ intellectual property may result in legal action and/or invoicing of additional fees.

12. Intellectual Property

All content on the Website, including text, images, branding, itineraries, and concepts, is the intellectual property of St-Arnaud Productions and may not be copied, reproduced, or used without prior written consent.

13. Privacy & Data Protection

12.1 Swiss Consumer Law

These Terms are governed by applicable Swiss consumer protection laws. Nothing in these Terms limits mandatory rights granted under Swiss law.

12.2 EU Consumer Rights (Where Applicable)

For clients residing in the European Union, mandatory consumer protection provisions under applicable EU regulations may apply, including rights related to pre-contractual information and transparency.

Please note that many services offered by Swiss Experiences fall under leisure services provided for a specific date or period and may therefore be exempt from statutory withdrawal rights once confirmed, in accordance with applicable law.

14. Governing Law & Jurisdiction

These Terms are governed by Swiss law. The exclusive place of jurisdiction is Switzerland.

15. Amendments

St-Arnaud Productions reserves the right to update or modify these Terms at any time. The version published on the Website at the time of booking shall apply.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
